Risk assessment: the key step in the establishing of the workstation sheet

The legal basis for the "workstation sheet" can be found in Chapter II of the "Belgian Code of Well-being at Work X.2. Temporary work" specifically in Articles X.2.3 to X.2.5 of the Code and Appendix X.2-1 of the Code. Below is the official text of the workplace wellness legislation.

Art. X.2-3.

§ 1st. Subject to the application of Article 17 of the Law of 24 July 1987, before a temporary worker is made available, the user undertaking provides the temporary work agency with all the information concerning the qualifications and occupational conditions and the specific characteristics of the workstation.

§ 2. To this end, the user undertaking shall draw up a workstation sheet, a template of which is given in Annex X.2-1, for each temporary worker employed in a workstation or function for which health surveillance is compulsory.

The workstation sheets are drawn up jointly with the competent prevention advisor in the internal service and the prevention advisor - occupational physician. The user undertaking shall indicate on the workstation sheet at least the following information which shall be based on the risk assessment referred to in Article I.2-6:

1° the unique identification of the workstation sheet and the date on which it is completed, as referred to in section A of Appendix X.2-1;

2° its contact information, as referred to in section B of Appendix X.2-1;

3° a detailed description of the characteristics of the workstation or function, as referred to in section E of Appendix X.2-1;

4° the immediate implementation of maternity protection measures, as referred to in section F of Appendix X.2-1;

5° an notification of the obligation to carry out health surveillance, as referred to in section G of Appendix X.2-1;

6° if health surveillance is mandatory, the notification of the type of workstation or activity, stating, where applicable, the nature of the specific risk, the list of which is available in section G of Appendix X.2-1;

7° the type of work clothing or PPE to be worn, as listed in section H of AppendixX.2-1;

8° an notification, where applicable, of the type of training provided, as referred to in section I of Appendix X.2-1;

§ 3. The user undertaking asks the Committee for advice concerning the workstation sheet and then forwards it to the Temporary Work Agency

Art. X.2-4.

The temporary work agency provides the following information on the workstation sheet:

1° its contact details and the issue date of a copy to the temporary worker, as referred to in section C of Appendix X.2-1;

2° the contact details of the temporary worker, as referred to in section D of Appendix X.2-1.

Art. X.2-5.

§ 1st. The exchange of data between the user undertaking and the temporary work agency relating to the workstation sheet takes place in the most appropriate way.

The form of the workstation sheet - the minimum content of which is attached to Appendix X.2-1 - is optional.

§ 2. The temporary work agency, for the duration of the temporary worker's employment with a user undertaking, keeps a duly completed copy of the workstation sheet, and gives a copy to the temporary worker.

The temporary work agency keeps the workstation sheets available to the prevention advisor - occupational physician and the official supervisor in the most accessible way.

The user undertaking, during the term of the temporary worker, keeps the workstation sheets at the disposal of the person in charge of the induction/initiation, as referred to in Article X.2-11, § 1, the competent prevention advisor of the internal service and the prevention advisor - occupational physician.
